Whereupon Comand was this day given to the Sheriffe of this County to bring here twelve
good & lawfull men of his Balywick, that the matter in hand might be the better understood
a List or pannel whereof are returned as followeth.. viz) James Curtiss. Alexander:Thomas
Lawrence Gary. -  -  -  -  -  -  -  - James:Langreen. Moses:ffenton. Richard Cary
Somerset:Dickinson. John:Gray Roger:Odowey  Thomas: Smith. William: Wallis Esau:
Boston. 12) who being legally Sumoned & Sworn upon the holy Evangelists, having
heard the foresd Declaracon. precept & the Evidence upon Oath receives their charge
& are Sent forth. _______  Evid Sw:for the plt was Jno:Mcknitt.
 
            And this day to witt the 17th: day as aforesd Came the Jurors between the
aforesd Killoch & Keen bein all unamously agreed of their verdict the plt & deft
being likewise calld, the verdict is read in these expresse words following (viz)  Wee
of the Jury doe find the defendt guilty according to the Evidence, that is to Say, for eleaven
bushels of Indian Corn.         James:Curtiss. foreman //
 
Which verdict was Ordered to be entered.  Ordr. granted for the Same als Executio _____

Contra                         }          Peter Whaples of this County was attached to answer
Peter: Whaples. Dft                          unto James Barry, in a plea of trespass on the Case
~   ~   ~   ~   ~    ~    ~                          And whereupon the plt by Jno.Strawbridge his Attorney
Comes & Sayes that the deft in the year of our Lord 1690: then became indebted unto the sd
plt, Seaven good Slaughter hides, and three paire of good (large) Shoos as will appear
in Court by evidence, which Said hides & Shoos as (aforesaid) the defendt did (pledge?) and
assume to pay to the plt when thereunto required but the(Defendant) minding his (promise)
& assumption but fraudulently intending ye plt to deceive in the aforesd Seaven (hides) & 
in the aforesd. Shoes but hath denyed to pay & still doth deny though often thereunto required
whereupon ye plt Saith he is damnified & hath losse to ye value of  1600lb of tob.& thereupon brings his Sute
