15 Augt 9th 1692 againe to Dormans Store (having desired the Deponents company with him and acquainted the said Dorman that since he the Said Dorman had sent him word by Capt William Whittington that the goods were all kept for him the Said Jenkins: that therefore he had not entered his action that there was to much noise about it allready Dorman Owned he had kept all the aforesd goods or all to A Small matter: not the value of five pounds disposed of then upon that the said Jenckins desired ye Said Dorman to Cull over the Said goods by the perticulers as they were Charged him that it might be Seen what was wanting: that if he would be honest at last the sd Jenckins delighted not in trouble and Should be very loath to go to Law: But Dorman Seing the writt was not which he expected would not then be perswaded to read over or to overhall one article of the Said Jenckins accot. but kept. & detained the Said goods abovementioned tells the said Jenckins he was only to have Such goods as he could Spare him: And So putts him againe to prove his bargaine & further saith not. Maryland Somerset Courty Ss // The Deposition of John: Perkins aged fourty eight years or their abouts Saith That being at Snow Hill at mr John: Dormans Store in Aprill last past where meeting with the said Dorman and wth my neighbour ffrancis Jenckins who were treating about fifty hogsheads of tobacco which the Said Jenckins had Sold him the said Dorman: the sd Jenckins blameing him So long waiting there. and that he had not his goods Sent down by the Mate according to bargaine Dorman replyed why he would Still Serve them for him and they should be Sent downe; and upon that went to find a key he missed of a Chest that he had for the said Jenckins in Order to p Secure the choicest of the goods in; which the sd Jenckins was to receive of the said Dorman for his tobaccoes abovesd, whereafter Credit given by the Said Dorman to the sd Jenckins for Six hundred Seaventy Six and a half pounds of tobacco for William Bowing Dorman upon a Satturday delivers the said Jenckins his Invoyce of his goods and the goods were called Over thereby & Dorman - - delivered of Every perticuler that he had left (as he said) his proportion according to y quantity (of) his tobacco would amount to: to Sixty five Severall articles as was told over before the Deponent and Severall others: the sd Jenckins neither objecting against the prices nor the goodness of the goods but took all of every Sort that Dorman would Spare: till at last Dorman brake into a passion and told the Said Jenckins he picked & Culled his goods, & Swore he should not have them: the sd Jenckins replyed that Could not be for he refused nothing as they were - - farr. Dorman Said then he had made no bargain with him and put the said Jenckins to prove Severall of the goods which Dorman delivered the Said Jenckins was marked with the said |
