County Commissioners will be negligible, thus necessitating
a large increase in the real estate tax; therefore
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the County Commissioners of St. Mary's County
be and they are hereby authorized and empowered to desig-
nate, by Resolution, the type of coin-operated machines upon
which the said gross receipts tax has been imposed by Resolu-
tion of said County Commissioners, or which may hereafter be
imposed under the provisions of Chapter 601 of 1947, or any
license fee authorized by this Act shall be imposed and that
the type of machine or machines so designated by said County
Commissioners shall be legal and lawful in said County, any
other law to the contrary notwithstanding.
The said County Commissioners are hereby authorized to-
impose, by Resolution, an annual license fee of not more than
Fifty Dollars ($50. 00) for each machine so designated, in
addition to the said gross receipts tax.
SEC. 2. And be it further enacted, That all Public General
Laws or Public Local Laws inconsistent with the provisions
of this Act be and they are hereby repealed to the extent of
such inconsistency.
SEC. 3. And be it further enacted, That before the provi-
sions of this Act shall become effective, the County Commis-
sioners of St. Mary's County shall submit the question to the
qualified voters of said County at a special election to be
called by said County Commissioners for the date of Tuesday,
December 9, 1947, at places to be designated by them. Notice
of said election stall be given by publication in at least one
newspaper printed and published in said County at least two
weeks before said election. The ballots shall be prepared by
said County Commissioners of said County and shall have
printed on them a condensed summary of the provisions of
this Act.
Printed on the said ballots shall also appear the words
"For the License Fee" and "Against the License Fee", with a
blank square opposite and to the right of each set of said
words. The voter shall indicate his choice by making a cross
mark (X) in one of said blank squares. The County Commis-
sioners shall appoint the necessary officers to conduct the
election with the usual pay for such duties.
If a majority of the persons voting on said question shall
cast their ballots marked "For the License Fee", then this
Act shall be immediately of full force and effect, but if a
majority of the persons voting on said question shall cast
their ballots marked "Against the License Fee", then this Act
shall be void and of no effect and the said County Commis-
sioners shall take no further action thereunder.
