licenses remaining unissued; and it shall be the duty of
the said clerks, on the said first days of June and December
of each and every year, or with ten days thereafter,
to pay to the Treasurer, all sums of money received
by them and due to the State, for licenses pursuant
to this act and the laws now in force, regulating
the issuing thereof.

     SEC. 4.  And be it enacted, That if any clerk of a
Circuit court of this State, or the clerk of the court of
Common Pleas of Baltimore, shall fail or neglect annually
on the first day of May, or at such other time or
times as may be necessary, to apply to the Comptroller
of the Treasury Department for blank licenses, in the
manner directed by this act, every clerk so failing or
neglecting, shall forfeit and pay for every such failure
or neglect, the sum of one thousand dollars.

     SEC. 5.  And be it enacted, That if any of the said
clerks so having received blank licenses as hereinbefore
directed, shall refuse or neglect to return to the Comptroller
of the Treasury Department, lists and accounts
of all licenses issued by him semi-annually, at the days
and times said in the manner provided by this act, the said
Comptroller shall forthwith charge such clerk or clerks
so neglecting or refusing, with the whole amount of
blank licenses, which shall have been delivered to such
clerk or clerks at the several rates fixed by law therefor,
and shall immediately thereafter prosecute a suit or
suits at law against the official bond of such clerk or
clerks for the recovery thereof, and the same proceedings
shall be thereon had, as are now provided in actions
against the bonds of delinquent collectors of the
direct tax.
     In case of

     SEC. 6.  And be it enacted, That the existing laws
regulating the issuing of licenses of the clerks of the
several courts of this State, and which may be inconsistent
with the provisions of this act, shall nevertheless
remain and continue in full force until this act shall take
effect, and from and after that period, all such laws or
parts of laws be and the same are hereby repealed.

     SEC. 7.  And be it enacted, That the several fines,
penalties and forfeitures imposed by this act, shall be
recovered by presentment or indictments in the name
of the State, in the Circuit court for the county where
the office liable therefor may reside, or in the Criminal
court of Baltimore as the case may be.

     SEC. 8.  And be it enacted, That this act shall take
effect from its passage.
