     SEC. 12.  And be it enacted, That the president and
directors of the said company shall be and they are hereby
invested with all the rights and powers necessary to the
construction and repair of a rail road from some suitable
point in Somerset county, in Maryland, said point to be
on some river emptying into Tangier Sound on the
Chesapeake Bay, to the north of Watkins' Point, or
on the said sound or bay to the north side of Watkins'
point, thence to run by or near the towns of Princess
Anne and Salisbury, to some suitable point on or near
the Philadelphia, Wilmington and Baltimore rail road,
or to the line dividing the States of Maryland and
Delaware; Provided, by constructing the said rail road
to the said line, a junction can thereby be effected with
some rail road or rail roads leading to and connecting
with the said Philadelphia, Wilmington and Baltimore
rail road, at any point thereof, the location of the said
road hereby authorised to be made, to be determined by
the said president and directors; Provided, that it shall
not be lawful to make or construct any rail road to the
line dividing the States of Maryland and Delaware, unless
a sufficient amount of stock for the making and construction
of a rail road through Maryland, to terminate
at or near Elkton in Cecil county, Maryland, shall fail
to be subscribed on or before the first day of March, in
the year of eighteen hundred and fifty-four, on or before
the expiration of six months, from the day on
which the books for receiving subscriptions to the stock
shall first be opened, in case the said books shall not be
opened before the first day of September, eighteen hundred
and fifty-three, the said road when completed, not
to be more than sixty-six feet wide, except at or near
the depots or stations, when the width may be made
greater, with as many tracts as the president and directors
may deem necessary; and the said president and
directors may cause to be made, or may contract with
others for making said rail road, or any part of it, and
they, their agents or those with whom they may contract,
or their agents may enter upon and use and excavate
any land which may be wanted for the site of
the said road, or the erection of warehouses or other
works necessary for the said road or for its construction
and repair, and that they may build bridges, fix scales
and weights, lay rails, may take and use earth, gravel,
stone, timber or other materials which may be needed
for the construction and repair of the said road, or of
any of its works, and may own and employ steamboats
or other vessels to connect the said rail road or rail roads
with other points by water communications; Provided,
nothing herein contained shall be so construed as to authorise
President and
directors invested
with all
powers necessary
for construction
