in the twenty-second section of the fourth article of
the Constitution of this State, or in the acts of Assembly
made in pursuance thereof, and the defendant or
defendants warned by such order, shall not within ten
days from and after the time limited for the appearance
of such defendant or defendants, consent with the
other parties to said cause, to the appointment of a
judge to try the same, then the clerk of said court upon
the announcement of such disqualification to him made
at the instance of the complainants in the cause, shall
notify the judge of any adjoining circuit, or the judge
of the court of common pleas of Baltimore city thereof,
who shall forthwith appoint a proper person to sit as
judge in said cause, and to try and dispose of the same,
and who shall be qualified in the mode required by the
act of eighteen hundred and fifty-two, chapter sixty-eight,
and shall receive like compensation for his services.

     SEC. 2.  And be it enacted, That this act shall take
effect from and after its passage.

                           CHAPTER 300.

AN ACT to provide for the election of Road Supervisors
                in the several counties of this State.



     Passed May
27, 1853.
     SECTION 1.  Be it enacted by the General Assembly
of Maryland,
That there shall be elected on the first
Wednesday of November, eighteen hundred and fifty-three,
and on the same day of every second year thereafter,
by the qualified voters of each election district in
the several counties of this State, one road supervisor,
who shall be a qualified voter, and a resident of the
district, whose duty it shall be, to superintend and
direct the repairs of the public county roads and bridges
within his election district, in such manner and under
such regulations and restrictions, as may be directed by
the county commissioners of his county.
     One road supervisor
to be
elected.
     SEC. 2.  And be it enacted, That the return judge
of each election district of the several counties, shall
make the returns for the election of road supervisors, at
the same time, and in the same manner, as other election
returns are required to be made; upon said returns
being made, the clerk of the circuit court shall certify
