the decision of the county commissioners in any case,
he, she or they shall have the right of entering an appeal
to the circuit court, at any time within sixty days
from the time of such decision by the county commissioners,
and the case shall be determined by the judge
thereof, or by a jury, at the option of either party.

CHAPTER 221.
AN ACT to incorporate the Cumberland Gas Light
Company.

SECTION 1. Be it enacted
by the General Assembly
of Maryland, That Thomas J. McKaig, Alpheus
Beall, James Hoye, Jr., Joseph Shriver, Normand
Bruce, Thomas Devicman, Daniel Saylor and Daniel
Blocher, be and they are hereby appointed commissioners,
under the direction of whom subscriptions may be
received to the capital stock of the Cumberland Gas
Light company hereby incorporated, or they or a majority
of them, may cause books to be opened at such
time and places as they may direct for the purpose of receiving
subscriptions to the said capital stock of said company,
after having given such notice of the time and
place of opening the same, as they may deem proper.

SEC. 2. And be it enacted,
That the capital stock
of the Cumberland Gas Light Company, shall not exceed
the sum of one hundred thousand dollars, divided
into shares of fifty dollars each, but as soon as four
hundred shares of said capital stock shall be subscribed,
the subscribers of the said stock, their successors and
assigns shall be, and they are hereby declared to be
incorporated into a company by the name and style of
the Cumberland Gas Light company, and by that name
shall be capable in law of purchasing, holding, selling,
leasing and conveying estates real, personal or mixed,
so far as it may be found necessary for the purposes
hereinafter mentioned; and shall have perpetual succession
by said corporate name, may sue and be sued,
plead and be impleaded, answer and be answered in
any court of law or equity, and may make and use a
common seal which they shall have the power to alter
or renew at pleasure, may ordain and establish by-laws
and ordinances for the regulation of the affairs of the
company, and may generally exercise such powers,
