to law, and had given such bonds for the faithful
performance
of their duties as such constables.

SEC. 2. And be it enacted,
That the said commissioners
for Washington county may in their discretion,
appoint any other, or as many other constables as they
may think necessary for the said county, to serve in the
said office of constable until the next regular election
and qualification of constables for said county, according
to the act of Assembly, passed at January session
eighteen hundred and fifty-two, chapter two hundred
and seventy-four, providing for the election of constables
and other officers in the city of Baltimore, and the
several counties of this State, and take from such constables
so as aforesaid to be appointed, the usual bond,
to be by them approved of, according to the acts of
Assembly in relation to constables bonds.

SEC. 3. And be it enacted,
That this act shall take
effect from the date of its passage.

CHAPTER 206.
AN ACT to amend the second section of an act passed
on the thirty-first day of March, eighteen hundred and
fifty-three, entitled, an act for the more effectual
suppression
of Crimes.

SECTION 1. Be it enacted
by the General Assembly
of Maryland, That the provisions of the second section
of the act passed on the thirty-first of March, eighteen
hundred and fifty-three, entitled, an act for the more
effectual suppression of crimes, shall extend only to
such assaults and batteries as are committed without
any provocation.

Amended.

SEC. 3. And be it enacted,
That the criminal court
of Baltimore city may fine or imprison, according
to its discretion, any person or persons, who may be
convicted of committing such assault and battery act,
or in any of the places mentioned in the said second
section; Provided, that such fine shall not be less than
the amount of the fine provided for in said section, or
in case of imprisonment in the jail or penitentiary, for
