     SEC. 3.  And be it further enacted, That for the
purpose of securing the early completion of the said
lateral branch rail road or rail roads, the president and
directors of the said Baltimore and Susquehanna rail
road company or a majority of them, are hereby authorised
and empowered, to contract with any incorporated
company, individual or individuals, to construct such
lateral branch rail road or rail roads, wharves or other
improvements deemed necessary for the accommodation
of the business of said company, and to mortgage
the same, the tolls and revenues thereof, the wharves
and other improvements or any property of said rail
road company, not now covered by mortgages to the
State of Maryland, and that said mortgage shall be the
first lien on the said lateral branch rail road or rail roads,
the tolls and revenues thereof, the wharves and other
improvements, and any property of said rail road company
not now covered by mortgages to the State of
Maryland; Provided however, that the rates of tolls or
charges for transportation on said lateral branch rail road
or rail roads, shall not exceed the rates authorised to be
charged by the original charter of said Baltimore and
Susquehanna rail road company or the supplements
thereto.

Proviso.
     SEC. 4.  And be it enacted, That he mayor and
city council of Baltimore, be authorised and empowered
to construct branches or to authorise individuals to do
the same, from the said proposed tracks, through or
along any street in said city, that may be deemed necessary,
subject to the same rules and regulations as are required
for private switches on the main line of said road.

     SEC. 5.  And be it enacted, That nothing contained
in this act shall authorise private property to be taken
for the use of the said company, without just compensation
as agreed upon between the parties or awarded by
a jury, being first paid or tendered to the party entitled
to such compensation.

     SEC. 6.  And be it further enacted, That this act
shall have no force or effect, until the same shall have
been accepted by the majority of the stockholders of
the Baltimore and Susquehanna rail road company in
general meeting assembled.
