that nothing herein contained shall be so construed as to bar
the said Elizabeth Philpot of her dower in said grounds if she
shall elect to claim the same, and in case a conveyance of the
fee of and in any part of said grounds shall be made in her lifetime,
she shall be entitled to such portion of the proceeds as the
Orphans' court of Baltimore county, shall according to the principles
of equity decree to her.

    6.  And provided further, That the power to make such lease
or leases as aforesaid, shall not be exercised unless the orphans'
court of Baltimore county aforesaid shall assent thereto.

                                            CHAPTER 65.

                            An act relating to actions of Replevin.

Passed Feb.
8, 1826.
    Sec. 1.  Be it enacted by the General Assembly of Maryland,
That in all cases where an apprentice hath been or hereafter
shall be taken from or detained against the will or consent of
his or her master or mistress.  The master or mistress, as the
case may be, shall have as full and ample right and power to recover
the possession of such apprentice, by action of replevin, as
the owner of a personal chattel has now by law to recover the
possession thereof.
Replevy apprentices.
    2.  And be it enacted, That in all actions of replevin hereafter
to be brought in any court of this state, if the defendant or defendants
shall be returned " summoned," and shall not appear
in person or by attorney, on or before the fourth day of the term
next, succeeding that to which such return shall be made, the
court shall be, and they are hereby authorised and required, on
motion, to enter up judgment for the plaintiff or plaintiffs, for the
property replevied and for nominal damages and costs.

                                            CHAPTER 66.

An act to authorise Aliens to purchase and hold Real Property within
                                                this State.

Passed Feb.
11, 1826.
    Sec. 1.  Be it enacted by the General Assembly of Maryland,
That from and after the passage of this act, aliens actual residents
of this state, shall be, and are hereby made able and capable
in law to take, have, hold, use and enjoy lands, tenements
and hereditaments within this state, which have heretofore been,
or may hereafter be purchased by such aliens, or to which they
would, if citizens be entitled by descent, and to sell and dispose
of the same in like manner, as if they were natural born citizens
of the United States:  Provided, That if any male alien shall acquire
any title to or interest in any real estate in virtue of this
act, such alien shall within one year after the acquisition of said
