and every year thereafter so long as it shall be necessary for the
final close of the concerns of said bank.

Proviso.

    2.  And be it enacted, That the said president and directors
when so met, shall have full power and authority to renew any
note or notes, that may be then due, or fall due thereafter, from
the said first Tuesday after the first Monday in March to the
first Tuesday after the second Monday in October, and from
said the said first Tuesday after the second Monday in October, to
the said first Tuesday after the first Monday in March, in each
and every year thereafter, so long as the same shall be necessary
for the final close of the affairs of said bank:  Provided, That
nothing in this act shall be so construed as to prevent the said
president and directors of the Bank of Caroline from adjourning
from time to time, as they may see proper, and that they may
renew notes due to said bank for a shorter time, or at any other
time or times, than is herein mentioned, whenever they may
deem it to the interest of the institution to do so or the convenience
of the debtors of said bank may require.
Repeal.     3.  And be it enacted, That any thing in the charter of the Bank
of Caroline or the act to which this is a supplement, contrary to
the provisions of this act, shall be, and the same is hereby repealed.

                                            CHAPTER 62.

An act to authorise the levy court of Frederick county to appoint commissioners
                              for the purposes therein mentioned.

Proviso.

    Sec. 1.  Be it enacted by the General Assembly of Maryland,
That the levy court of Frederick county, be, and they are hereby
authorised and empowered to appoint three commissioners
to lay out and make public certain streets, lanes or alleys in
and near Middletown, in Frederick county, Maryland; Provided,
That the said levy court shall be first satisfied that the said
streets, lanes or alleys, are required by the convenience of the
inhabitants of said town; And provided also, That the said
commissioners shall, before they proceed to open said streets,
lanes or alleys, ascertain and determine the amount of damage
which may be sustained by any individual or individuals, by
means of the opening of such streets, lanes or alleys, and make
a return to the said levy court, setting forth the names of the
person or persons who may be so entitled to damages, and the
amount of such damages; which sum when so ascertained,
shall be assessed by the levy court on the assessable property of
Middletown, and paid over to the parties respectively entitled to
receive the same.
Shall be non-residents.     2.  And be it enacted, That the three commissioners herein
before directed to be appointed, shall not reside within three
miles of Middletown at the time of their appointment, nor hold
real property within said town.
