Proviso.

                        JOS. KENT, ESQ. GOVERNOR.

fifty third section of the act, to which this is a supplement, resignations
are directed to be made who shall within five days after such
writ forward it to the governor and council and apply for commissions
for the officer or officers so recommended; Provided however,
That in the first organization of the fifth infantry regiment
and regiment of cavalry as aforesaid, the notice for the meetings
to recommend the several officers in said regiments be issued by
the commanding officer of the first regiment of riflemen, and the
certified proceedings made to him who shall forward them and
apply for commissions as aforesaid.  And if any officer shall neglect
or refuse to comply with any of the provisions of this section
as required of him, he shall be cashiered or fined a sum not
exceeding one hundred dollars in the discretion of such court
martial as the case may require.

    Days of parade.     8.  And be it enacted, That the said brigade shall assemble
for militia duty on the second monday in April, second monday
in May, second monday in June, and second monday in October,
agreeably to the provisions of the thirteenth section of the
original act, and the second section of the supplement thereto
passed at the last session.
Power to punish
disorderly
conduct.
    9.  And be it enacted, That on all occasions when the said
brigade or any part of it, is called out, whether for drill or otherwise,
the commanding and other officers shall have power to
punish the disorderly conduct of officers, non-commissioned officers,
privates, musicians and by-standers as are given to them
in the forty ninth and fiftieth sections of the act to which this is
a supplement, when they are called out on the days of parade
as prescribed by this act.
    Enrollment
of volunteers.
    10.  And be it enacted, That the same privileges that are given
to the several uniformed volunteer regiments in the forty first
section of the act to which this is a supplement, to keep up their
respective compliment of men by the enrollment of volunteers
from the different districts of the city, are hereby allowed to the
regiments of the said brigade.
    Original act
applied.
    11.  And be it enacted, That all the provisions of the original
act and the supplement thereto, not inconsistent with the provisions
of this act shall apply to the said brigade in the same manner
and to the same extent, as they do to the other uniformed
volunteer corps in the division aforesaid.
    Respecting
arms.
    12.  And be it enacted, That the infantry companies hereinbefore
mentioned, shall be and are hereby authorised to surrender
to the proper authority, the arms and accoutrements in their
possession and belonging to the state, and the bonds heretofore
given for such arms shall be thereupon cancelled and for the
purpose of procuring arms, the same mode shall be pursued that
is directed by the act to which this is an additional supplement
and the supplement and supplements thereto:
    Acts inconsistent
herewith
repealed.
    13.  And be it enacted, That any clause, matter or thing in the
said original act or supplement thereto inconsistent with the provisions
