            JOSEPH KENT, ESQUIRE, GOVERNOR.

by this charter; and the said bye-laws from time to time to alter,
change or repeal:  Provided, That no bye-law shall be made
contrary to the provisions of this charter, or the constitution
and laws of this state, or of the state of Pennsylvania.

    Subscription
on part of the
state; conditions.
    7.  And be it enacted, That whenever the governor and council,
for the time being, shall be satisfied, that there hath been actually
subscribed by bona fide and competent subscribers, such
sum, as together with the sum of five hundred thousand dollars, is
sufficient to make the said canal, in pursuance of the provisions
of the twenty-first section of the act " for the promotion of internal
improvement," and of the dimensions set forth in the report
of the commissioners upon the practicability and expense
of a canal from the Susquehannah to the city of Baltimore, and
upon the certificate of the board of public works that the said
canal is practicable; then the treasurer of the Western Shore
shall be, and he is hereby authorized and required to subscribe
on behalf of this state for five thousand shares in the capital
stock of the said Susquehannah and Patapsco Canal Company.
    Connections
with said canal.
    8.  And be it enacted, That the sid president and directors,
in constructing the said canal, shall, and they are hereby required
to provide for a communication with the said canal, by locks
or otherwise, from the river Susquehannah, at some point between
the head of tide and Havre-de-Grace, the mouth of the
Conestogo, and the town of Columbia, and also at any other
point they may deem condusive to the interests of said company,
and beneficial to the trade of the river.

    9.  And be it enacted, That the proprietors of the Susquehannah
Canal, incorporated by the act entitled " an act for making
the river Susquehannah navigable from the line of the state to
tide water," and the supplements thereto, be and they are hereby
authorised to subscribe for fifteen hundred shares of the capital
stock of the said Susquehannah and Patapsco Canal Company;
the same to be paid by a full conveyance of their right, title,
interest and estate, to, and in the said Susquehannah Canal,
to the president and directors of the said Susquehannah and Patapsco
Canal Company, hereby created; to be made whenever
the canal contemplated by this act shall have been completed
from York Haven to tide water; and thereupon all the rights,
interests, claims, property, and estate, together with the privileges
and chartered immunities of the said Susquehannah Canal
Company, shall be vested in the said president and directors of
the Susquehannah and Patapsco Canal Company, in as full and
ample a manner, as the same are now held, enjoyed, and possessed
by the said Susquehannah Canal Company, by virtue of the
original act of incorporation and supplements thereto.
    Assent of
Pennsylvania
required.
    10.  And be it enacted, That the subscription herein authorised
on the part of this state, shall not be made until the state of
Pennsylvania shall assent to and confirm this charter, so that
the same may have full effect and operation within the limits of
that state.
