Senate bill entitled an Act to repeal and re enact
with amendments section K), of Article 65, of the
Code of Public General Laws, title "Militia," sub-
title "Commissions," and sections 88, 89, 42 and 43,
of said Article, sub-title "Maryland National Guard,"
and to add new sections thereto, &c.
Endorsed: "Passed by yeas and nays, with pro-
posed. amendments:
AMENDMENTS PROPOSED.
Strike ont section 39, and insert in lieu thereof the
following:
Section 39. Any member of the Maryland National
Guard who shall wilfully or unlawfully misapply or
convert to his own use any money or other property be-
longing to said Maryland National Guard, or any
organization thereof, or who shall, when lawfully
called upon so to do by the proper officer of said
Maryland National Guard, fail or refuse to pay or
deliver to said officer any such money or property in
his possession, or for which the said member was
chargeable or accountable, shall be guilty of a misde-
meanor, and upon conviction thereof before a court of
competent jurisdiction, shall be fined a sum not ex-
ceeding five hundred dollars or imprisoned in jail not
exceeding one year, or both fined and imprisoned as
aforesaid, in the discretion of the court."
