AN ACT to repeal sections sixty-five, seventy, sev-
|
 
|
enty-two, seventy-four, seventy-nine and eighty of
|
 
|
article twenty-eight, of the Code of Public Gen-
|
 
|
eral Laws, title " County Commissioners," sub-title
|
 
|
"Draining Lands," and re-enact the same with
|
 
|
amendments.
|
 
|
SECTION 1. And be it enacted by the General As-
|
 
|
sembly of Maryland, That sections sixty-five, sev-
|

eighty of article twenty-eight of the Code of Public

amended and
re-enacted.

"Draining Land," be repealed, amended and re-
|
 
|
enacted so as to read as follows :
|
 
|
SEC. 65. And be it enacted, Whenever the owner
|
 
|
or owners of any swamp or low grounds shall deem
it fit to have them drained, if the owners of said
|

lands cannot agree, or should any be "femes covert,
|
 
|
infants, non compos mentis" or non-residents of the
|
 
|
county or counties where the awamp or low lands
|
 
|
are situated, they, or any of them, may petition the
|
 
|
County Commissioners sitting in the county where
|
 
|
such swamps or low lands or any part thereof are
|
 
|
situated for the appointment of commissioners to
|
 
|
locate or lay out a ditch or ditches for the purpose ;
|
 
|
and when such swamp or low lands are situated in
|
 
|
two or more adjoining counties, the County Com-
|
 
|
missioners of the county to which applications shall
|
 
|
