CHAPTER 58.


AN ACT to make effectual the provisions made by


the act of December session, eighteen hundred


and forty-four, chapter two hundred and eighty-


one, entitled " An act to provide for the comple-


tion of the Chesapeake and Ohio Canal to Cum-


berland, and for other purposes," in so far as said


act relates to putting and keeping the said Chesa-


peake and Ohio Canal in good condition and re-


pair, and to make the said canal an effective


means of transportation.


Whereas it was provided by the act passed by the
General Assembly of Maryland, at its December ses-


sion, eighteen hundred and forty-four, chapter two


hundred and eighty-one, that the President and

Directors of the Chesapeake and Ohio Canal Com-


pany should, from time to time, and at all times


thereafter, have the privilege and authority to use


and apply such portion of the revenues and tolls of


the said company as in their opinion might be neces-


sary to put and keep the said canal in good condi-


tion and repair for transportation, and provide the


requisite supply of water and pay the salaries of


officers and agents and the current expenses of the


said company. And whereas it was further pro-
vided by the said act that the President and Directors


of the said Chesapeake and Ohio Canal Company


should have the authority to execute any deed, mort-


gage or other instrument of writing that might there-


after be deemed necessary or expedient to give the


fullest effect to the powers aforesaid. And whereas,


under the provisions of the said act, the rights and


liens of this State upon the revenues of the Chesa-


peake and Ohio Canal Company were directed to be

held and considered as waived, deferred and post-


poned in favor of any bonds that might be issued


by the Chesapeake and Ohio Canal Company for


the purpose of putting and keeping the said canal


in good condition and repair for transportation, and


providing the requisite supply of water, and paying
