hereinbefore named and designated shall be fully con-

structed at a cost of less than said sum of two dollars and
|

twenty-one cents per linear foot then the unexpended
|

balance or surplus from said drain shall be appropriated to
|

|
the completion of any drain hereinbefore named and desig-
|
|
|
|
nated if there shall be found to be a deficiency in the sum
|
|
|
|
appropriated for the completion of any of said drains ; and

|
for the purpose of defraying the cost and expenses of con -
|
|
|
|
demning, laying out, making, altering, changing and macad-
|
|
|
|
amizing streets, the mayor and council of Hagerstown are

authorized and empowered to borrow an additional sum of

money, not to exceed thirty thousand dollars, on the faith

and credit of the town as hereinafter provided, which shall

be known and designated as the. special street fund to be

used and applied exclusively in the following manner,

to-wit : first, three thousand dollars thereof shall be used
|

and applied exclusively to the liquidation and payment of
|
|
|
|
judgments now recorded against the mayor and council for

and on account of damages incurred in condemning, laying

judgments that may hereafter be entered against the said

laying out, opening, widening, altering or changing any

|

street, lane, alley, water course or drain so far as said
|
|
|
|
sum shall be adequate; second, twenty-seven thousand
|
|
|
|
dollars thereof shall be used and applied exclusively to
|
|
|
|
grade and macadamize such portions of streets as are herein-
|
|
|
|
after named that have not been graded and macadamized,
|
|
|
|
viz : North Mulberry street, South Mulberry Street, Salem
|
|
|
|
avenue, Lee street between Potomac and Mulberry, Prospect
|
|
|
|
street, North street, Wayside avenue, Winter street, Fair
|
|
|
|
Ground avenue, James street, Green lane, Alexander street,

|
|
|
George street, Norway avenue, Antietam street, Church
|
|
|
|
street, Bethel street, West Franklin street, Broadway
|
|
|
|
avenue, Mary Ann street, South Potomac street, Jackson
|
|
|
|
lane, Valeutiue street, Lee Roy street, Jefferson street, Bal-
|
|
|
|
timore street, Frederick street, Forest street, Cook street,
|
|
|
|
and Mechanics street, and warrants for the expenditure
|
|
|
|
of the same shall be drawn by the board of street com-
|
|
|
|
missioners, as provided in section one hundred and sixty-
|
|
|
|
seven of this article.

|
202. To provide for borrowing the money as authorized
|
|
|
|
by the preceding section, the mayor and council are empow-
|
|
|
|
ered to issue bonds in such denominations as they may
|
|
|
|
determine ; said bonds to be signed by the mayor and attested
|
|
|
|
