175 H. No licensee under this act shall sell or furnish to
|
|
|
|
any person intoxicating, spirituous or fermented liquor on
|

licensee is a hotel keeper he may supply such liquor to be

drunk in their room or with their meals to bona fide guests,

nor except in hotels shall conduct his business in any place
|
|
|
|
to which an entrance shall be allowed other than from a
|
|
|
|
public travel-way.
|
|
|
|
175 I. Druggists and apothecaries shall not be required
|
|
|
|
to obtain license under the provisions of this act, but they
|

shall not sell intoxicating liquors nor compound or mix any
|
|
|
|
composition thereof except upon the written prescription of
|
|
|
|
a regular physician, nor more than once on any one pre-
|
|
|
|
scription of any physician, and said prescription shall be
|
|
|
|
filed and preserved by the druggist or apothecary filling the
|
|
|
|
same, and upon complaint verified by affidavit, shall be
|
|
|
|
produced before the Circuit Court for Allegany County
|
|
|
|
when required ; and any failure to comply with the provisions
|
|
|
|
of this section shall render such drugigst or apothecary so
|
|
|
|
failing liable to the same penalties as if he had sold intoxi-
|
|
|
|
cating liquors without license.
|
|
|
|
175 J. Any person who shall hereafter be convicted of
|
|
|
|
selling intoxicating, spitituous or fermented liquors or any
|

admixture thereof, within the corporate limits of the city of
|
license.
|
|
|
Cumberland without a license under the provisions of this
|
|
|
|
act shall be sentenced to pay a fine of not less than one
|
|
|
|
hundred dollars nor more than five hundred dollars, or
|
|
|
|
undergo imprisonment in the county jail of not less than
|
|
|
|
three months nor more than twelve months, or both fine and
|
|
|
|
imprisonment in the discretion of the court before which
|
|
|
|
such offender or offenders shall be tried.
|
|
|
|
175 K. The license of any person having a license under
|
|
|
|
the provisions of this act who shall hereafter be convicted
|

of violating any of the provisions of this act, or of the
|
|
|
|
conditions of his license shall be revoked, and he shall be
|
|
|
|
subjected to a fine of not less than fifty dollars nor more
|
|
|
|
than two hundred dollars, or to imprisonment in the county
|
|
|
|
jail for not less than thirty days nor more than six months
|
|
|
|
or both fine and imprisonment in the discretion of the court
|
|
|
|
before which such conviction shall occur ; and in default of
|
|
|
|
payment of any fine and costs so imposed the bond herein
|
|
|
|
provided for shall be put in suit for the recovery thereof;
|
|
|
|
the license of any person who permits minors to frequent or
|
|
|
|
loiter about his place, or disreputable or disorderly persons
|
