widen, straighten, extend or close any such street or alley as they


may determine is proper, in accordance with said application ;.

tion of their work make a report of their proceedings, giving width


of any such street or alley to said mayor and common council, to-

shall give their reasons as to whether the public welfare or con-


venience requires the same or not, and the amount of damages, if


any, that shall he awarded to the parties whose property or rights


are affected thereby; and provided, further, that it shall be the


duty of said mayor and common council to cause a copy of said


report and plat to be retained and recorded among the proceed-


ings of said corporation, and said original report shall be forth-


with sent to the clerk of the circuit court for Garrett county, to


be by him recorded among the land records of said county, after


confirmation by said mayor and common council, as hereinafter


provided; and they shall have the right to confirm or reject the


same at any time after sixty days from the filing of said report;


provided, further, that said mayor and common council shall have


power to assess either generally on the whole assessable property


in said town, or specially on the property of the persons benefited,


the whole or any part of the damages and expenses which will be
in curred in laying out, opening, widening, straightening, extending

or closing of any such street or alley, or grading the same, which


grading they shall have the right to do in their discretion, and


they shall have power to provide for collecting and paying for


any such compensation or expenses; and provided, further, that


the compensation of said examiners, or any two of them who shall


see proper to act, shall be at the rate of three dollars per day for


their services, and they shall also have the right to employ a sur-


veyor, whose compensation shall be at the rate of four dollars per


day, which said expenses shall be assessed with the other expenses


of said proceedings, in the discretion of said mayor and common


council.


SEC. 82. If any person shall feel aggrieved by the decision of


said mayor and common council, upon the report of said exami-


ners, he or they may appeal therefrom at any time within sixty


days after said report snail have been filed and ratified, or rejected


by said mayor and common council, to the circuit court for Gar-


rett county, which said appeal shall be taken by filing a written

notice thereof with the clerk of said mayor and common council,


and a similar notice to the clerk of the circuit court for Garrett


county, whereupon it shall be the duty of said clerk of the cir-


cuit court to place said appeal upon the trial docket of the next


succeeding term of said court, and he shall immediately file said


original report of said examiners in said appeal case, which shall


be considered the record in said cause, and he shall make the per-


son or the persons taking said appeal plaintiff in said cause, and
