CHAPTER 617.


AN ACT to declare and give the sanction and consent of the


General Assembly of Maryland to the devise and bequest con-


tained in the last will and testament of Edward Day, late of


Baltimore county, deceased, of ten shares of the capital stock


of the national farmers and merchants bank of Baltimore to


St. John's parish of Harford and Baltimore counties.


WHEREAS, Edward Day, late of Baltimore county, deceased, by


his last will and testament, bearing date the twenty-ninth day of


January, in the year eighteen hundred and thirty-eight, duly ad-


mitted to probate, and of record in the office of the register of


wills of Baltimore city, in liber D. M. P., number nineteen, folio-


one hundred and forty-two, &c., devised as follows, viz : for the


purpose of contributing towards the maintenance of divine worship
at the place aforesaid, I do hereby give and bequeath unto my son,
Ishmael Day, his executors, administrators or assigns, ten shares


of stock of the bank of farmers and merchants, standing on said

books in my name, in trust, that the Eector of St. John's parish


aforesaid, for the time being, shall have the right to receive all


dividends or interest which may arise from the same, so long as


he shall be the officiating minister in said parish of St. John's


and if any doubt should arise of the solvency of said bank, and


the bishop for the time being of the said protestant episcopal


church shall advise a sale of said stock, and an investment of the


value of said stock in some other safe and permanent institution


for the purpose aforesaid, I do hereby authorize the said Ishmael


Day, his executors, administrators or assigns, or any of them, to


sell said stock and make investment accordingly, he or they hav-


ing previously obtained the free consent of said bishop, to be first


obtained in writing; and,


WHEREAS, the said farmers and merchants bank since the

bank under the act of the congress of the United States of


America, under the name and style of the national farmers and


merchants bank of Baltimore, and said ten shares of stock still


stand upon its books in the name of said Edward Day; therefore
