return of said judges of election and proclamation of said clerk,
|
|
|
|
that a majority of all the votes cast as prescribed in the preced-
|
|
|
|
ing sections in said county, has been cast for the sale of said spiri-
|
|
|
|
tuous or fermented liquors or alcoholic bitters, the same shall
|
|
|
|
be sold as allowed under the license laws of this State subject to
|
|
|
|
the provisions hereinafter mentioned or provided.
|
|
|
|
SEC. 4. And be it enacted, That if any person or persons, house,
|
|
|
|
company, association or body corporate shall sell, directly or in-
|
|
|
|
directly, any spirituous or fermented liquors or alcoholic bitters
|
|
|
|
within the limits of said county, if a majority of all the votes
|

cast shall have been against the sale of liquors or bitters after the

fourth day of November, in the year eighteen hundred and ninety,
|
|
|
|
he, she, they or it shall on conviction thereof, forfeit and pay a
|
|
|

fine of not less than fifty nor more than three hundred dollars
|
|
|
|
and costs of prosecution, or instead of such fine, imprisonment
|
|
|
|
in the county jail for thirty days, or both in the discretion of the
|
|
|
|
court.
|

|
|
SEC. 5. And be it enacted, That in addition to the respective
|
|
|
|
amounts to be paid by any person or persons, house, corporation,
|
|
|
|
company or association for taking out license under article fifty-
|
|
|
|
six, of the Code of Public General Laws, and the supplementary
|
License.
|
|
|
acts thereto, relating to spirituous or fermented liquors by re-
|
|
|
|
tailers and oyster or eating houses, or under any other section of
|
|
|
|
said article, the said person or persons, house, corporation, com-
|
|
|
|
pany or association, shall if he, she, they or it intends to sell or
|
|
|
|
barter spirituous or fermented liquors or alcoholic bitters or all
|
|
|
|
combined in quantities more than a pint or less than a pint, or
|
|
|
|
by the drink, that such applicant or applicants shall in addition
|
|
|
|
to the amount to be paid the State of Maryland, pay to the clerk
|
|
|
|
of the circuit court for Garrett county the further sum of twenty-
|
|
|
|
five dollars for the use of the public schools of said Garrett county
|
|
|
|
before any such license shall hp granted, and if any person or
|
|
|
|
persons, house, corporation, company or association shall open or
|
|
|
|
keep any oyster house, cook shop or victualing house, or lager
|
|
|
|
beer saloon, or any other than an ordinary at or in which spirit-
|
|
|
|
uous or fermented liquors or lager beer may be sold or bartered
|
|
|
|
in quantities less than a pint at any one time, or by the drink,
|
|
|
|
that such applicant or applicants shall in addition to the amount
|
|
|
|
to be paid the State of Maryland, shall also pay to the clerk of
|
|
|
|
said circuit court the further sum of twenty-five dollars for the
|
|
|
|
use of said public schools.
|
|
|
|
SEC. 6. And be it enacted, That no spirituous or fermented
|
|
|
|
liquors or alcoholic bitters shall be sold in any election district
|
|
|
|
of said county, except as provided for by section five of this act,
|
|
|
|
and also upon the following terms : that each and every applicant,
|
|
|
|
person or persons, house, corporation, company or association,
|
|
|
|
shall be recommended to said clerk by seven respectable free-
|
