SEC. 2. And be it further enacted, That this act shall take effect

CHAPTER 63.


AN ACT to re-imburse certain moneys erroneously paid into the


State treasury by E. Z. Tower, clerk circuit court for Garrett


county.


WHEREAS, B. Z. Tower, clerk circuit court for Garrett county,


did issue two foot peddlers' licenses in May and August of eighteen


hundred and eighty-nine, and returned the money therefor into

the State treasury, to wit : the sum of one hundred and sixty-six


dollars and twenty-five cents; after such return was made the


State's attorney for Garrett county gave as his opinion that such


licenses were erroneously issued and should be suppressed, and the


moneys refunded by the clerk to the parties holding the same, and


the clerk of the circuit court acting in pursuance of said opinion


took up said licenses refunding the holders thereof the moneys


they had erroneously paid; now, therefore


SECTION 1. Be it enacted by the General Assembly of Maryland,


That the comptroller of the treasury is hereby authorized and di-


rected to draw his warrant upon the treasurer in favor of B. Z.

To repay.

Tower, clerk circuit court for Garrett county, for one hundred and


sixty-six dollars and twenty-five cents.

Effective.

SEC. 2. And be it enacted, That this act shall take effect from


the date of its passage.

AN ACT to repeal and re-enact with amendments section thirty
(30,) of article sixteen (16,) of the Code of Public General
Laws of Maryland, title "Chancery," sub-title "Declaratory

Decrees."
