award, made by referees under rule of court, upon which judg-

ment or decree execution shall issue without stay, no matter affect-

ing the title of real estate however, shall be submitted to or arbi-
|
|
|
|
trated by the said committee under this or the preceding section ;
|
|
|
|
but the committee may direct in its awards the payment of the
|
|
|
|
costs and expenses of the arbitration, and the amount thereof
|
|
|
|
shall be embraced as a principal sum in the judgment or decree
|
|
|
|
to be rendered, if awarded to be paid by the party against whom
|
|
|
|
such judgment or decree is sought, no judgment or decree ren-
|
|
|

dered on any award under this act shall be liable to be stayed, ex-

cept under allegation under oath of the defendant of manifest

fraud in the procurement or rendition of the award, or of a ma-
|
|
|
|
terial and substantial failure of the committee, specially alleged
|
|
|
|
and set forth, to comply with the by-laws of this act, in the hear-
|
|
|
|
ing and determination of the matter submitted; nor shall any
|
|
|
|
judgment or decree be quashed, modified or stricken out, except
|
|
|
|
upon satisfactory proof of the matters so required to be so alleged,
|
|
|
|
neither shall there be any appeal in any case from the original
|
|
|
|
judgment, order or decree, whereby after a hearing of the alle-
|
|
|
|
gations and proofs as aforesaid, the said original judgment or
|
|
|
|
decree shall be maintained.
|

|
|
SEC. 11. Andbe it enacted, That this act shall take effect im-
|
|
|

mediately from and after its passage; the General Assembly re-

serving to itself the right to alter, amend or repeal the same at
|

pleasure.

CHAPTER 337.
|

|
AN ACT to authorize and empower the mayor of Frederick city
|
|
|
|
to commit tramps to the Maryland house of correction.
|
|
|
|
SECTION 1. Be it enacted ty the General Assembly of Maryland,
|
|
|
|
That the mayor of Frederick city shall have the same power,
|
|
|
|
authority and jurisdiction with reference to and in the case of
|
|
|

county, by chapter thirty-one, of the acts of the General Assem-
bly of Maryland, passed at the January session eighteen hundred

and eighty, being sections two hundred and seventy-five, and two
|
|
|
|
hundred and seventy-six, of article twenty-seven, of the Code of
|
|
|
|
Public General Laws of Maryland, entitled " Crimes and Punish-
|
|
|
|
ments," sub-title " Vagrants and Tramps."

SEC. 2. And be it enacted, That this act shall take effect from
|
|
|
|
the day of its passage.
