the construction of said road according to the specifications fur-


nished by said examiners, and the contract shall be awarded to the


lowest responsible bidder; provided, the contract price shall not


exceed the amount of the net assessments collected for the build-


ing of said road, and that the person or persons contracting for


the building of said road shall give bond to the county commis-


sioners in double the amount of the contract price for the faith-


ful performance of the contract; and the county commissioners


shall not pay in full for making such road until the same shall


have been thoroughly examined and accepted by them.


SEC. 210. That in the event of the failure of the county com-


missioners to secure the services of competent road commissioners


upon terms prescribed in the last preceding section of this act,


they are hereby authorized to appoint proper persons to act aa


road commissioners, which persons shall be real estate owners ia

roads in their districts, and the road commissioners to be thus,
