AN ACT to repeal sections one hundred and seventy-four and


one hundred and seventy-nine, of article twenty, of the Code


of Public Local Laws, title "Somerset county," sub-title "Oys-


ters," and to re-enact the same with amendments.


SECTION 1. Be it enacted by the General Assembly of Maryland,

seventy-nine, of article twenty, of the Code of Public Local Laws,

hereby repealed and re-enacted so as to read as follows :


174. Any person or persons violating any of the provisions

seventy-tw6, of this article, shall be fined for the first offense,


not less than fifty nor more than two hundred dollars, and for


second offense, at any time after conviction of the first offense,


not less than one hundred nor more than five hundred dollars,


and shall stand committed until fine and costs are paid, and on

sections to any justice of the peace of Somerset county, he shall


issue his warrant to the sheriff or constable of said county, re-


quiring either of them to summon a posse comitatus if necessary,


and to proceed at once to arrest the party or parties alleged to


have been engaged in the violation of the provisions of said sec-


tions, and forthwith bring the offender or offenders before some


justice of the peace in and for Somerset county for a hearing,.


and the said justice shall either give the case an immediate hear-


ing, or he shall at the instance of the party or parties charged,


appoint some day within the next seven days thereafter to hear


the case, first requiring the defendant or defendants to give good.

the trial; and if the defendant or defendants shall be found guilty
