CHAPTER 319.


AN ACT to prohibit horses, cattle and other domestic animals


from going at large on the public roads or streets in the village


of Liberty, in Frederick county, Maryland, and on the public


roads within half a mile of the methodist protestant church


in said village.


SECTION 1. Be it enacted by the General Assembly of Maryland,


That it shall not be lawful for horses, cows, calves, bulls, heifers,


steers or other cattle, sheep, swine or domestic animals of any

kind, to go or beat large in or on any of the public roads or streets

at large.

on any of the public roads of said county within half a mile of

SEC. 2. And be it enacted, That any and every person, or per-


sons, owning said animals, or any of them, mentioned in the pre-


ceding section, who shall permit said animals, or any of them, to


go or be at large on any of the public roads or streets mentioned


in the preceding section shall be fined not loss than on e dollar nor


more than five dollars for each offense, on conviction before any


justice of the peace of said county, and on failure or refusal to

pay said fine and the costs of prosecution to the justice of the


peace before whom said person shall be so convicted, shall be com-


mitted to the jail of said county and confined therein for not less


than five days nor more than thirty days; provided, that any per-


son so convicted shall have the right of appeal to the circuit


court for said county upon giving bond in a sum to be fixed by


said justice sufficient to secure the payment of said fine and costs


and the probable costs in said court, conditioned that if the party


appealing shall not prosecute his appeal with effect at the next


term of the circuit court for said county, and also pay and satisfy


said fines and costs, and the costs in said circuit court in case the


judgment shall be affirmed, then the said bond to be and remain


in full force and virtue, otherwise to be of no effect.


SEC. 3. And be it enacted, That whenever any county constable

of said county shall find or shall be informed that any of the

animals mentioned in the preceding sections are going at large in
