or consolidated company as they were of the said

Baltimore and Cumberland Valley Railway Com-

pany; provided, however, that all the rights and

|

|

remedies of any creditors of said Baltimore and

|

Cumberland Valley Railway Company, and all liens

|
|

and rights to liens upon the property of said company
shall be preserved unimpaired ; and all debts, liabili-

attach to and be enforceable against said new or

|
|
consolidated corporation to the same extent as if

|

such debts, liabilities, contracts and duties had been

incurred or contracted by it.

SEC. 5. And be it enacted, That suits may be
|
|
|
|
|
brought against such consolidated company in any
|
|
|
|
|
of the courts of this State, for all causes of action,
|

in the same manner as against other corporations of

suits.

|
|
said State, and process may be served upon the pres-

ident, director or other officer, or if there should be
|
|
|
|

no such officer in the county or city where the suit

shall be brought, then upon any of the conductors

or managers of trains in its employment.

|
SEC. 6. And be it enacted, That if a consolida-
|
|
|
|
|
tion shall be effected between the Baltimore and
|
|
|
|
|
Cumberland Valley Railway Company and said Bal-
|
|
|
|
|
timore and Cumberland Valley Railroad Company,
|

and the consolidated company shall desire to con-

date with oth-
ers.

|
|
solidate with one or more companies owning or about
|
|
|
|
|
to construct a railroad to or in the direction of Ship-
|
|
|
|
|
pensburg, such consolidation may be made in the
|
|
|
|
|
manner and subject to the restrictions hereinbefore
|
|
|
|
|
stated.
|
|
|
|
|
SEC. 7. And be it enacted, That the said Balti-
|
|
|
|
|
more and Cumberland Valley Railway Company,
|
|
|
|
|
and any consolidated company which may be form-
|
|
|
|
|
ed under the provisions of this act, be and they are
|
|
|
|
|
hereby authorized and empowered to execute to the
|

Western Maryland Railroad Company, its successors

to execute a

and assigns, a lease of the railroad and other prop-
|
lease.

|

ing to the lessees the privilege of purchasing the
