said company may erect one or more toll-gates upon
said road, but not within two miles of each other,

and may charge tolls for traveling on said road; pro-

vided said tolls shall not exceed the following rates,

to wit : One and one-half cents per mile for every
|
|
|
|
vehicle drawn by one animal ; for any vehicle drawn

by two animals three cents per mile, and for every

vehicle drawn by more than two animals one and
|
|
|
|
one-half cents per mile for every additional animal;

for every score of sheep, or swine, or neat cattle, six

cents per mile; for every horse and rider, and every
|
|
|
|
led or driven horse, one cent per mile.

|
|
SEC. 8. And be it enacted. That the directors of
|
|
|
|
said company shall have power to make and adopt
such by-laws, rules and regulations for the direc-

tion and management of said company as may, in

|
|
|
their judgment, be necessary for the purpose of their
|
|
|
|
incorporation, not inconsistant with the provisions
|
|
|
|
of this charter, and the laws and constitution of
|
|
|
|
this State ; and the president and directors of said
|
|
|
|
company, or a majority of them, shall constitute, ap-
|
|
|
|
point and employ such officers, agents and servants
|
|
|
|
tor the construction, preservation and repair of said
|
|
|
|
road, and for the receipt and collection of tolls, and
|
|
|
|
the transaction of all other business of said com-
|
|
|
|
pany, as in their judgment may be necessary.
|
|
|
|
SEC. 9. And be it enacted, That if any person
|
|
|
|
or persons whatever, riding or driving anything
whatever, or leading the same, shall therewith pass
|

through any private gate or bar, or turn off said

road with the intention of avoiding the payment of
|
|
|
|
toll for passing through such gate, all and every
|
|
|
|
person so offending shall, for every such offence,
|
|
|
|
forfeit and pay to the said president and directors a

|
|
|
sum not exceeding twenty dollars, to be sued for
|
|
|
|
and recovered, with costs of suit, before any justice
|
|
|
|
of the peace, in like manner as debts of similar
|

|
amount may be sued for and recovered ; and if any
|
|
|
|
toll gatherer shall demand and knowingly receive
|
|
|
|
any greater toll than he is authorized to receive by
|
|
|
|
this act, he shall forfeit ten dollars for every such
|
|
|
|
offence for the use of the county.
