such court may, in its discretion, sentence such person to be
confined in said house of correction instead of other place of
confinement.

467. When any person shall be convicted of larceny in any
court of this State and such court shall be of the opinion that
the interest of public justice will be best promoted by sentenc-
ing the person so convicted to the house of correction instead
of the penitentiary, it shall have power to sentence such person
to be confined in the house of correction instead of the peniten-
tiary; provided, that the said term of confinement in the said
house of correction shall not be for a less period than may now
or hereafter be lawfully imposed for the offense of which such
person was so convicted, and that such person so sentenced to
confinement in said house of correction be not sentenced to be
confined therein for a longer period than three years.

468. Any person, not insane, who is convicted of being a
tramp, shall be sentenced by the justice of the peace, or by the
court, as the case may be, before whom such offender is tried,
to confinement in the house of correction for a period of not
less than two months nor more than one year.

469. When any person is convicted in any court of this State
of assault and battery, riot, or any other misdemeanor punish-
able under the laws of this State by imprisonment in jail or by
fine and imprisonment in jail, such court shall have power to
sentence such person to be confined in the house of correction;

of correction shall not be for a less period than two months.
