such offense.

Minors—Obtaining Liquor Under False Statement of Age.

1890, ch. 470, sec. 1.

323. Any person under the age of twenty-one years who
knowingly and wilfully makes any misrepresentation or false
statement as to his age, and by reason of such misrepresenta-
tion or false statement obtains any spirituous or fermented
liquors from any other person licensed to sell such spirituous
or fermented liquors under the laws of this State, shall be
deemed guilty of a misdemeanor, and upon, conviction thereof
shall be fined not less than one dollar nor more than twenty
dollars, or imprisoned in jail for not less than five days nor
more than thirty days, or be both fined and imprisoned, in the
discretion of the court; provided, that the testimony given by
any minor or person under twenty-one years of age in the
prosecution of any person for selling liquor to minors under
the laws of this State shall not be used against such minor in
prosecution under this section.

324. Any person who obtains any spirituous or fermented
liquors from any other person licensed to sell the same for any
minor or person under twenty-one years of age, knowing him
to be such, to be drunk by said minor or person under twenty-
one years of age, shall be deemed guilty of a misdemeanor,
and upon conviction thereof shall be fined not less than twenty
dollars nor more than fifty dollars, or imprisoned in jail for not
less than thirty days nor more than ninety days, or be both
fined and imprisoned in the discretion of the court.

325. It shall not be lawful for any dealer, vendor or other
person or persons or body corporate engaged in the manufac-
ture of cigars, cigarettes or tobacco, or in any occupation in
which the buying or selling of said goods, wares and merchan-
dise shall constitute the whole or any part of his, her, its or
their occupation, to sell, barter or give any cigar or cigars,
cigarette or cigarettes, smoking or chewing tobacco to any
minor under the age of fifteen years, unless previously author-
ized in writing by the parent or guardian of such minor, or
