irresponsible, the officer preferring the charge shall demand
of the purchaser of the cargo to withhold and pay over to the
proper authority such amount, and if said purchaser shall
refuse or fail to do so, the amount shall be recovered from
him by writ of fi. fa. on the judgment obtained against the
party who has so violated the law. The certificate herein pro-
vided for shall be in form following, and the blank spaces
shall be filled out in ink, and numbers shall be written in full:

11. Any packer, commission man, boatman or other person
who shall conspire or agree with any other person to evade
any of the provisions of this article, or who shall connive at
or participate in such violation shall be guilty of a misde-
meanor. It shall be unlawful for any captain or other person
in charge of a vessel to discharge his oysters, or for any
packing-house, or any other person, to receive oysters between
the hours of 8 o'clock P. M. and 6 o'clock A. M. Any viola-
