854 CECIL COUNTY. [ART. 8

bona fide resided in said town for the space of six months, and
twelve months in the State next preceding the election, shall,
elect by ballot on the last Monday in February in each year,
at such house as shall be designated by the president and com-
missioners, by a notice to be put up in at least five of the most
public places in said town, at least one week before the day of
election, seven judicious and discreet persons, citizens of the
United States, who shall have resided within the limits of said
town for at least twelve months preceding the election, as com-
missioners of said town; the persons thus elected as commission-
ers shall, within one month after their election, qualify by taking
the oath prescribed by the sixth section of the first article of the
constitution of Maryland, before a justice of the peace in and for
Cecil county; and at their first meeting, which shall be within
one month after the election, they shall choose from their own-
body a president, who shall preside at all meetings of the com-
missioners, and vote on all questions before them.

249. All such elections shall be held and conducted as shall,
from time to time be directed by the by-laws of the corporation,
not inconsistent with the provisions of this sub-title of this article..

250. If any of said commissioners, after they are elected, shall
refuse to qualify, or shall, after they have qualified, die, resign,
remove from said town, or be otherwise disqualified, an election
to fill said vacancy shall be held after two weeks' previous pub-
lic notice, to be put up as aforesaid by said president and commis-
sioners, by hand-bills, written or printed, and posted at the post-
office and at three other public places in said town; provided, that
no election to fill vacancies shall be held so long as five of the
commissioners who have been duly elected and qualified shall
remain; and the said remaining commissioners, not less than five,
shall have all the powers conferred upon said president and com-
missioners as fully to all intents and purposes as if the whole
seven were in office, duly qualified.
