trap, used or contrived for the purposes forbidden by section 164,
shall be prima facie evidence against its possessor of its being
possessed for the purpose of violating that section.

169. Nothing in section 164 shall be construed to prohibit
the use, as now by law allowed, of what are known as hauling
seines when laid ont from and landed on the shore.

170. It shall not be lawful for any person to lash or beat the
waters of the Elk and Bohemia rivers, with rods, poles or sticks,
or any other instrument, or to make noises on the decks of any
boat, or any part of said boat, for the purpose of driving fish
into any net or seine within a half a mill of Plum, Locust, Hen-
derson's, Rich Neck, Welsh, Lorts or Oldfield's points or Heron
island, on the Elk river, or Town, Rich, Parlor, Long, Hackett's
or George's points, on the Bohemia river, when said points and
island are occupied by persons engaged in gunning for wild fowl
with decoys in the water, nor within a half mile of the bridge
over the Bohemia river when occupied by persons gunning for
wild fowl from said bridge, unless the consent of such persons is
first obtained to such fishing as aforesaid; nor shall it be lawful to
fish as aforesaid on the waters of the Elk and Bohemia rivers from
the first day of April to the first day of September of each year.

171. Any person violating any of the provisions of the pre-
ceding section, upon arrest and conviction thereof before a jus-
tice of the peace in and for Cecil county, shall be fined not less
than ten nor more than twenty-five dollars, to be recovered as
other small debts are recovered; and all fines imposed under
said section shall be divided as follows: one-half to the officer
making the arrest, and the other half to the county commission-
ers of Cecil county, to be applied by them to the use and
benefit of the county.
