830 CECIL COUNTY. [ART. 8.

over to the president and commissioners such sum as they may
see fit, to aid in keeping the streets of the town, as part of the
public roads of the county, in good repair.

1880, ch. 435.

154. If the inhabitants of the town shall at any time neglect
to make an election as herein directed, the power of electing
commissioners shall not thereupon cease, but shall continue as
though such election had been made; and the president and com-
missioners for the time being shall remain in office until such
.annual election shall be held.

FENCES.

155. When any persons shall join fences for their mutual
advantage, each shall keep up and in good repair his proper pro-
portion thereof; and if either, upon the request of the other,
shall fail to make or repair his proportion within twenty days,
the party suffering by such failure may apply to some justice of
the peace of the county, who, upon proof that the fence is down,
or out of repair, may authorize the person applying, to make or
repair the same.

156. The person making or repairing a fence under the pro-
visions of the last aforegoing section may recover his costs and
expenses in the same manner as other debts.

157. The county commissioners shall appoint annually, a
constable in the district adjoining the Bald Friar ferry, on the
Susquehanna river, whose duty it shall be to examine every fish
pot erected in the river, at least once a week, during the season
that young shad usually descend the river; and if he find any fish
pot or net erected in the river within the limits of Cecil county,
wherein the bottom slats shall be more than one and a half inehes
wide, or placed together closer than three-quarters of an inch, or
not rounded on the top part, or with the bottom thereof covered
