courts of equity, a per diem of five dollars for each day he may
be necessarily engaged in performing the duty the said orders or
warrants enjoin upon him; and in case it shall be 'necessary for
him, in performing his duties in any of said cases, to survey
under ground, in coal, or other mines, he shall be entitled to
charge a per diem of seven dollars for each day he may be so
engaged surveying under ground; and where the same shall be
required by the person for whom the service is rendered, the sur-
veyor shall state his account for such services under oath; and he
may demand his per diem for his services at the end of each and
every day of the rendering of such services, from the person for
whom the same are rendered; and if such party or parties refuse
to pay the same, he may decline and refuse to render any further
services in the matter until such demand is complied with.

229. Said surveyor shall be entitled to an office in one of the
public buildings of the county, to be furnished by the county
commissioners, and to consist of two rooms, in one of which,
shall be kept the public records of the county, open at all reason-
able hours to public inspection; and if the county commis-
sioners shall so prefer, they may, instead of furnishing such office
to said surveyor, levy and pay to him a sum of not less than one
hundred nor more than one hundred and twenty-five dollars per an-
num, for office rent; provided, that the said surveyor shall always
keep all public records in his possession open to public inspection
in said office, at all reasonable hours; and provided further, that
said surveyor's office shall always be kept in the city of Cumber-
land.

230. Said surveyor shall be entitled to charge for searches of
the records in his possession, or for making extracts or copies
therefrom, the same fees as are allowed to clerks of circuit courts
in this State for similar services.
