for the use of the county, for every such neglect or refusal, the
sum of one hundred dollars, to be recovered by indictment in the
circuit court.
COUNTY TREASURER AND CLERK TO THE COUNTY
COMMISSIONERS.

23. The legal voters of Carroll county, at each general elec-
tion held in said county, shall elect by ballot a treasurer for said
county, who shall also be clerk to the county commissioners; the
said treasurer, before he enters upon the duties of his office, shall
take an oath, in due form of law, to well and faithfully perform
the duties of county treasurer and clerk to the county commis-
sioners, and shall also execute and deliver to the county commis-
sioners a good and sufficient bond, to be approved by them, in
the penal sum of twenty thousand dollars, for the faithful per-
formance of his duty as treasurer; and if the said treasurer shall
fail to execute said bond within sixty days after he shall have
been appointed or elected, he shall forfeit his office, and the
county commissioners shall declare the said office vacant, and
shall proceed to fill the same by the appointment of some
suitable person for the remainder of the term for which he shall
have been elected or appointed; and such appointee, before he
enters upon the duties of his office, shall execute and deliver a
bond of the same tenor and in like manner, and take an oath in
due form of law to faithfully perform the duties of his office as-
hereinbefore directed; the county commissioners may, at any
time, demand of said treasurer such further bond, with such fur-
ther security, as in their judgment the interest of the county may
require, and shall prescribe for the said treasurer office hours,
during which said office shall be kept open.

24. The said treasurer and clerk shall be entitled to such com-
pensation as the county commissioners may think proper, not
exceeding eight hundred dollars per annum; he shall receive and
pay over, according to the directions of law or the order of the
county commissioners, the proceeds of all taxes levied in said
county, and shall keep full accounts of all monies received and
