the party maiming, killing or otherwise injuring said stock, shall
be entitled to prove the amount of damage done by such stock in
mitigation of the damage for the killing and maiming thereof.

80. None but citizens of Calvert county shall, for any purpose

whatsoever, haul a seine or any other instrument, in the waters
of Battle creek, Hunting creek or St. Leonard's creek, in said

county.

81. No person whatsoever shall haul a seine or any other
instrument, in said waters of Battle creek, or use Hunting creek
or St. Leonard's creek for the purpose of catching fish for sale,
or for any other purpose than for home consumption.

82. Any person violating either of the two preceding sections
shall be deemed guilty of a misdemeanor, and upon conviction
before a justice of the peace shall be fined not less than ten nor
more than fifty dollars, one-half to be paid to the informer and
the other half to the county commissioners, for county purposes;
and either the State or the defendant shall have the same right
of appeal from the judgments of said justices as is now allowed

in civil cases.

83. The boat and seine found in the possession of any person
violating sections 80 and 81, shall be responsible for said fine.

84. The sum of $500,000 is hereby appropriated and set apart
for the construction of works of internal improvement in St
Mary's, Charles and Calvert counties, to be distributed to the said
counties, respectively, as follows: To Charles county the sum of
$175,000; to St. Mary's the sum of $173,000; to Calvert county

the sum of $152,000; and as soon as it shall appear to the
treasurer of this State by the affidavit of the president of any
railroad company now chartered or which may hereafter be
chartered in said counties, respectively, that bona fide subscrip-
tions to the capital stock of any such company equal in amount
to the sums hereby authorized and directed to be given to such
