1876, ch. 128.

35. Section 32 shall not be construed to interfere with the
right of any citizen in the said counties to take the young of the
birds mentioned in said section; provided, he make oath in due
form of law before some justice of the peace of the county in

-which he resides, that such young birds taken are intended for
his true and bona fide use, and not for the purpose of sale or
barter; such oath may be made before or at the time of trial, but
shall only be prima fade evidence of innocence.

1884, ch. 75.

36. No person shall shoot, trap, or in any manner catch or kill
any partridges between the llth day of January, said day inclu-
sive, and the 1st day of November, within the limits of Calvert
county.

37. Any person violating the preceding section shall pay a
fine of five dollars for each and every offence, to be recovered
before a justice of the peace in and for said county, and to be
applied to the public school fund of said county.

BRIDGES.

1876, ch. 879.

38. The county commissioners of Calvert, Anne Arundel and
Prince George's counties, are authorized, whenever in their judg-
ment public interest requires it, to provide free travel over the
Patuxent river, at or near Hill's bridge.

39. When, in the judgment of said county commissioners,
public interest shall require said provision, they may negotiate

with the owner of Hill's bridge, and purchase and maintain the
same as a public highway free of toll; provided, the price de-
manded be not a greater sum than it would take to build a new
bridge near the site of the present one.

40. In the event of the purchase or building of a bridge, the
cost of the structure shall be divided between Calvert, Anne
