driving wild ducks or water fowl of any kind from their feeding
or roosting grounds on said waters, every such person shall be
deemed guilty of a misdemeanor, and on conviction of having
violated this section shall pay a fine of not less than fifty dollars
nor more than two hundred dollars for each and every offence.

262. If any person shall, in, on or over the waters aforesaid,
erect or cause to be erected any booby blind or artificial point at
a greater distance than one hundred yards from the natural shore
from which the same may be extended, every such person shall
be deemed guilty of a misdemeanor, and on conviction of having
violated this section shall pay a fine of not less than fifty dollars
nor more than two hundred dollars for each and every offence,
and shall be subject to the same penalty once in every week so
long as the same is allowed to remain.

263. Any person upon whom any of the fines provided for by
the four preceding sections shall be imposed, shall, in every case,
in default of payment of the same, be committed to jail for not
less than thirty days nor more than six months, or until said fine
and all costs be paid; and all and every sink boat, sneak boat,
float, decoy, duck gun of any kind, ammunition and apparatus of
every kind whatsoever for use in shooting at or killing wild ducks
or other water fowl found to have been in the possession of such
person at the time of violating any of the provisions of said sec-
tions, or in his possession at the time of his arrest, shall be for-
feited, condemned and sold as hereinafter provided.

264. Any sheriff, constable or commissioned militia officer
who shall be satisfied, either upon his own view or from informa-
tion received from any other person, whether on oath or not, that
any person has violated any of the provisions of said sections,
shall be authorized and empowered to arrest and take into custody
such person so offending, and to seize and take into his custody
any of and all the articles hereinbefore enumerated, found to have
been or to be in the possession of such person.
