State, in and for the county in which the owner of said progeny
resides, and swearing to the correctness of his claim, shall have
issued a writ of fieri facias upon the said progeny, which writ
shall be directed to some constable or other officer, who there-
upon shall seize said progeny and sell the same under the pro-
visions of the code of public general laws regulating sales under
execution from justices of the peace.

262. After the expenses attending such sale, and the amount
of the lien upon said progeny have been satisfied, the balance, if
any, shall be paid to the owner of such property sold.

263. The county commissioners are required to allow to and
levy for the use of the State's attorney for Worcester county, in
all cases which may be hereafter tried by him in said county, the
fees following, to wit: in every case of murder, arson or rape,
twenty dollars; in every case of felony, other than murder, arson
or rape, ten dollars; in every case of misdemeanor, punishable by
confinement in the penitentiary, five dollars; and in all other mis-
demeanors, three dollars and thirty-three cents and one-third of a
cent.

264. In all civil or criminal cases where the State's attorney
for said county appears and tries cases, when it is his duty to
appear and try cases, as prescribed by law, the judges of the first
judicial circuit of Maryland, or any one of the said judges may,
in their or his discretion, allow such fees to the State's attorney of
said county, in addition to what are now allowed by law, in each
and every case, as the said judge or judges may think just and
proper, to be levied by the county commissioners; provided, that
no additional fees shall be allowed where the total appearance and
trial fees allowed by law to the said State's attorney amount to
the sum of one thousand dollars in one year; and provided fur-
ther, that this section shall not be so construed as to include the.
fees and commissions of the said State's attorney allowed and paid
by the State.
