his successors, upon the order of the county commissioners, any
surplus that may remain in his hands; and the said supervisor
shall make the said report, under oath, once in twelve months;
and it shall contain, in addition to the things hereinbefore pro-
vided, a true account of all the moneys received and expended,
the name of each and every man who has performed the labor
herein required of him, the number of days he has worked, and
the time when and the road on which the said labor was per-
formed.

230. Any person liable to labor as aforesaid who shall refuse
to obey such summons, and shall refuse to labor on said public
roads, as hereinbefore provided, for one or two days, as here-
inbefore specified, and shall refuse or neglect, upon demand
made as aforesaid, to pay to said supervisor the sum of one
dollar and fifty cents per day for one or two days' labor as
aforesaid, or shall refuse or neglect to furnish a substitute as
aforesaid, shall be deemed guilty of a misdemeanor, and shall,
upon complaint made by such supervisor, be liable to be arrested
and brought before any justice of the peace in the county, upon
a warrant to be issued by said justice in the name of the State
therefor, and shall, upon proof of such summons and failure to
obey the same and refusal to pay said sum of one dollar and fifty
cents per day for not exceeding two days, be fined to an amount
equal to said sum of one dollar and fifty cents per day for not
exceeding two days, and all costs of such proceeding before said
justice, including the pay for the witnesses for the prosecution;
and the said justice, in order to enforce the collection of said
fines, shall have the power to issue an execution upon the judg-
ment therefor and to make it a part of said judgment, and the
party against whom any such judgment is rendered shall stand
committed to the county jail until such fine and costs be paid,
but said imprisonment shall not exceed ten days for any one
offence; provided, that any party against whom any justice of the
peace may render a judgment under any of the preceding sec-
tions of this sub-title of this article, may, at any time within ten
days after the rendition of such judgment, appeal from such judg-
ment to the circuit court for Worcester county; provided, the
party so appealing shall give bond with surety to the State of
Maryland, to be approved by the said justice of the peace, in the
