1876, ch. 146

141. The provisions of this sub-title of this article shall not
apply to sales by the manufacturer of cider which is not drunk on
the premises of the manufacturer, nor to sales of spirituous or
fermented liquors by the manufacturer thereof, to any person
licensed to sell intoxicating liquor in said county.

142. Any vendor of intoxicating liquor sold in said county
shall be liable to pay damages to any husband, wife, parent,
employer or other person injured by reason of any person being
intoxicated, in whole or in part, by liquor sold by said vendor;
said damages to be ascertained by a justice of the peace for said
county, when the sum claimed does not exceed five dollars, with-
out appeal, but if the amount claimed shall exceed five dollars,
then in the same manner as debts for like amounts are now
recovered by law.

143. Nothing in this sub-title of this article shall be construed
to authorize any sale or barter or giving away of any spirituous
or fermented liquor or lager beer on the Sabbath day, commonly
called Sunday, or on the day of any election held in said county
under the constitution and laws of this State or of the United
States.

144. In any prosecution under this sub-title of this article, it
shall only be necessary to state that the traverser did sell, barter
or give away spirituous liquor or fermented liquor without speci-
fying the particular kind of liquor so sold, bartered or given
away.

145. All fines imposed under the provisions of this sub-title of
this article shall be paid over to the board of county school com-
missioners of Worcester county for the benefit of the public
schools of said county.
