form the said labor; and the said supervisor shall collect and ac-
count under oath, at least once a year, and as often as may be
required, to the said county commissioners, for all sums of money
so collected, and shall apply the same or pay it over to the said
commissioners, as they may direct.

119. Any person failing to obey such summons, and refusing
upon such demand, to pay to the said supervisor the sum of one

dollar, shall be guilty of a misdemeanor, and upon complaint
made by such supervisor, shall be arrested and brought before
some justice of the peace of the said county, upon a warrant to
be issued by said justice, in the name of the State of Maryland
therefor, and upon proof of such summons and failure to obey
the same, and refusal to pay the said sum of one dollar, shall be
fined one dollar and all costs of the proceedings; and the said
justice, in order to enforce the collection of the said fine and
costs, shall have the power to issue an execution therefor against
the property of the defendant; and the party against whom any
such judgment is rendered, shall stand committed to the jail until
the said fine and costs are paid, the said confinement not to ex-
ceed in any one case ten days; provided, nevertheless, that the
defendant shall have the privilege of an appeal to the circuit
court for the county.

120. The road supervisor of each road district shall enroll the
names of all persons in his road district, liable to service, in a
book kept for that purpose; he shall also keep a separate list of
those who work when ordered, and a similar list of those who fail
to obey his summons; which list shall be subject to the examina-
tion of any citizen of said county when desired.

121. The county commissioners shall require the road super-
visors appointed by them, to give bond to the State of Maryland,

with good and sufficient security, to be approved by them in
such sums as they may deem proper, conditioned for the faithful
and diligent performance, by the said supervisors, of all the
duties required of them; which said bonds may be put in suit for
the use and benefit of any one suffering by reason of the neglect
