37. The said commissioners may pass all ordinances not con-
trary to the laws of this State necessary to give effect and opera-
tion to the power vested in them, and in the absence of ordinances,
the law of the county shall be the law of the town.

38. All fines and penalties shall be for the use of said town,
and all ordinances shall be made public by being posted in at
least three public places in said town.

39. Wicomico, Somerset, Queen Anne's, Montgomery, Dor
Chester, Allegany, St. Mary's, Calvert, Caroline, Carroll, Prince
George's, Washington, Worcester, Kent, Garrett and Cecil coun-
ties, and Baltimore city, and all cities, towns or boroughs in which
dogs are taxed by municipal ordinance, are exempted from the
operation of sections 157-162 of article 81 of the code of public
general laws, title "Revenue and Taxes," providing for the tax-
ation of dogs in this State.

40. Wicomico county is divided into ten election districts ac-
cording to their present names, bounds and limits, in each of which
districts all elections for public officers shall be held at the places
now fixed by law.

41. All fields and other grounds kept for enclosure in Wicom-
ico county, shall be fenced with post and rail or plank, or worm
fences, made of good and substantial rails, at least four feet high
from the ground to the top of the upper rail; and the first or
under rail, in post and rail, or plank, or worm fences, shall not
exceed five inches from the ground or embankment, on which
the same is or may be built; and the width between the rails or
planks, comprising the fence, shall be such as is usual in the con-
