SHARPSBURG.

347. The citizens of the town of Sharpsburg and Miller's Ad-
dition to Sharpsburg, in Washington county, are a body corpo-
rate by the name of "The Burgess and Commissioners of Sharps-
burg," and by that name may sue and be sued, and may have
and use a common seal.

348. The male citizens of said town, of the age of twenty-one
years and upwards, who have resided therein for six months next
preceding the election, on the first Wednesday in September, or
on some other day to be fixed by the ordinances of the said town,
shall annually elect by ballot, a burgess, assistant burgess and five
commissioners of Sharpsburg, who shall have the same qualifica-
tions as the voters.

349. All elections shall be held and conducted as shall from
time to time be directed by the by-laws of the corporation, not
contrary to the provisions of this charter.

350. If, during the year for which they were elected, the bur-
gess, assistant burgess or any of the commissioners shall die,
remove from the town, resign, be non compos mentis or displaced,
an election to fill the vacancy shall be held after ten days' notice,
at which all persons shall be entitled to vote who are qualified to
vote at a regular election.

351. If at any election a choice of burgess, assistant burgess
and commissioners shall not be made by reason of a tie or equal-
ity of votes, a second election shall be held after not less than
ten days' notice, and so on, until such choice shall be made; and
the burgess and commissioners for the time being shall continue
in office until their successors are duly elected.

352. The burgess, assistant burgess and commissioners, before
entering upon the duties of their respective offices, shall take an
oath before some justice of the peace of Washington county, to
