county, shall be sentenced to pay a fine of not less than ten nor
more than twenty dollars, and upon failure to pay the same
shall be committed to the county jail for not less than ten
nor more than twenty days; one-half of said fine to go to
the informer, and the other half to the school fund of the
county; provided, that the party charged shall be entitled to de-
mand a jury trial before the case is heard by the justice of the
peace, and upon such demand shall be recognized to appear at
the next term of the circuit court.
BOONSBOROUGH.

35. The citizens of Boonsborough, Slifer's addition, Holler's
addition and Allabaugh addition, to Boonsborough, in Washing-
county, are a body corporate, by the name of "The Burgess and
Commissioners of Boonsborough," and by that name may sue
and be sued, and may have and use a common seal.

36. The bounds of the town of Boonsborough shall embrace
the space of three-fourths of a mile square, the centre of which
is what is known and called as the square in said town, and whose
lines shall be parallel to the lines of said square.

37. The male citizens of said town, of the age of twenty-one
years and upwards, and who have resided therein six months
next preceding the election, shall elect by ballot, on the first
Monday in March in each year, at such house as shall be directed
by the burgess and commissioners, a burgess and assistant burgess
and five commissioners, for said town, who have resided therein
for six months next preceding the election.

38. All elections shall be held and conducted as shall from
time to time be directed by the by-laws of the corporation, not
contrary to the provisions of this charter, after ten days' public
notice given by said burgess and commissioners; but the failure
to give such notice shall not invalidate any election.
