185. It shall be the duty of the sheriff, constable and officers
of the State fishery force, to arrest any person, and to seize any
canoe, boat or vessel .found violating any of the provisions of
section 180, and bring the offender before a justice of the peace
in Somerset county, to be dealt with as herein provided; and if
the vessel so unlawfully employed be seized, but the master or
owner shall not be arrested, and shall wilfully fail to appear, the
justice of the peace may proceed to hear the charge against the
boat without such appearance; and if it shall appear that the
said boat has been unlawfully used in violating any of the pro-
visions of said sections, shall condemn the said boat, and order a
sale thereof as provided for in the preceding section; but in such
case the owner or master of said canoe, boat or vessel, or any one
interested in the said canoe, boat or vessel, shall have the right of
appeal to the circuit court for Somerset county, which shall hear
and determine the said case as in other cases of appeal from
justices of the peace.

186. It shall not be lawful for any person to employ any
canoe, boat or vessel, in catching or taking oysters with scoop,
scrape, drag or dredge, or any similar instrument, within the
waters of Pocomoke sound, in Somerset county; nor shall any
person take or catch oysters for sale within said waters otherwise
than with tongs, as restricted and regulated by the provisions of
the general oyster law in force in this State.

187. Any person violating the provisions of the preceding
section shall be fined in a sum not less than seventy-five dollars
nor more than one hundred and fifty dollars for each and every
offence, and shall stand committed to the county jail until such,
fine and the costs of suit are paid.

188. On information made under oath, of any violation of
the provisions of said section, to any justice of the peace of Som-
erset county, he shall forthwith issue his warrant to the sheriff or
any constable of said county, requiring said officer to proceed.
