114. The judgment, assessment and report of the two persons
hereinbefore provided for, to be appointed by the justice of the
peace, shall in no case be taken and held to be conclusive and
final; but either party on trial shall be at liberty and have the
right to produce witnesses to maintain or controvert all matters at
issue in the case; and the court, before which the case is to be
determined, shall give such judgment, upon all the evidence, as
may seem right and proper; and nothing in this sub-title of
this article contained shall be taken or considered as giving juris-
diction to any justice of the peace to hear and determine any

cause-wherein the title of land is concerned.

115. The provisions of the seven preceding sections shall not
apply to that part of Tangier district which comprises Deal's
island, as the same is now surrounded by water.

116. No person shall stake out or fix any seine across the
river Wicomico, in Somerset county, or aid therein, by which fish

may be obstructed in going up or coming down said river.

117. Any person offending against the provisions of the pre-

ceding section shall, for every offence, forfeit the sum of twenty
dollars, to be recovered by action or indictment in the circuit
court for the county where the offender shall be apprehended or
resides, one half to die informer and the other half to the county.

118. Any person may destroy or remove any seine staked or

fixed across said river to obstruct the passage of fish, and if he be
sued therefor, he may plead the general issue and give the special
matter in evidence.
