peace of the county wherein such offence was committed, to be.
dealt with as provided for in the preceding section.

174. If any person convicted of offending against any of the
provisions of said sections shall think himself aggrieved by such
conviction, he may appeal from the judgment of the justice of
the peace before whom such conviction is had, at any time within,
ten days from the rendition thereof, to the circuit court for the
county in which the trial was had. If any resistance be made
to the officer directed to execute sections 168-173 of this sub-title
of this article, by any persons offending against the same, the said
officer shall summon the posse comitatus, and proceed therewith
without delay to execute his duty under such •warrant. The justice
before whom such offenders shall be taken, shall have full power
to issue summons for all witnesses that be named to him, to com-
pel their appearance and examine them under oath.

175. The keeper of the jail of Queen Anne's county shall be
appointed by the sheriff of said county, and shall hold his office
during good behavior, removable by the sheriff, or by a present-
ment of the grand jury of said county and conviction of miscon-
duct in the circuit court for said county.

176. He shall qualify by taking an oath before a justice of"
the peace for said county, that ho will well and faithfully keep'
all prisoners who shall be committed to the jail of said county,
and that he will, in all respects, truly and honestly demean him-
self in his office of keeper of said jail without prejudice, affection,
malice, hatred or partiality, so long as he shall continue in said
office; and also by entering into a recognizance before the said
justice, with two sufficient sureties, in the sum of four hundred
dollars, in the usual form, with the condition therewith, " that if
the said A. B. do and shall well and faithfully execute and per-
form the office of keeper of the jail of Queen Anne's county, and
find and provide wholesome and sufficient victuals for all and.
