every alternate year, accounting from the year eighteen hundred
and seventy-four, five persons to act as commissioners of said
village, all of whom shall have resided within said village three
years immediately preceding the day of election, and each, of
whom shall be the owner, in his own right, of real or personal
estate therein, assessed at not less than three hundred dollars, and
which shall have been assessed in his name, on the assessment
books of said village, at least twelve months preceding the day of
election.

44. The commissioners of said village shall appoint three per
sons from among the voters thereof, who shall give at least five
days' notice, by posting not less than three written or printed
notices in conspicuous public places in said village, of the time
and place at which said election shall be held; and the said
judges of election, before opening the polls, shall make oath or
affirmation before some justice of the peace for Prince George's
county, that they will fairly and impartially act as judges of said
election; and the said judges shall keep the polls open from nine,
o'clock, A. M. until six o'clock, P. M., and shall record the names
of the voters, and after the closing of the polls shall count the
ballots and announce the result, and make and sign a certificate
thereof to be filed among the records of said corporation.

45. If any vacancy shall occur by the death, resignation, re-
moval or refusal to act of any commissioner of said village, or if
any person elected as commissioner of said village shall be
disqualified from any cause, the remaining commissioners shall
elect a proper person to fill such vacancy; and all cases of con-
tested election of said commissioners shall be decided by the
judges of the circuit court for Prince George's county; and
pending any contest, and until the said court shall decide who is
legally elected, the commissioners holding the office by virtue of
a previous election shall continue to hold the office until the
contested election is decided, and until their successors shall be
legally elected and qualified.
